1. CONTEMPT. — Under the facts as stated in the opinion: Held, That the acts of the defendant in the court of the justice of the peace did not constitute contempt.


D E C I S I O N


JOHNSON, J.:


This defendant was charged in the Court of First Instance of the Province of Occidental Negros with the offense of desacato (contempt), under the provisions of the Penal Code. He was arrested, duly arraigned, and, after hearing the evidence adduced during the trial of the cause, the lower court found him guilty of said offense and sentenced him to be imprisoned for a period of four months and one day of arrest mayor and to pay a fine of 325 pesetas, with the costs of the trial, and in case of insolvency to suffer subsidiary imprisonment at the rate of 12
