PRESIDENTIAL DECREE No. 185 May 7, 1973

TRANSFERRING FROM THE DEPARTMENT OF JUSTICE TO THE SUPREME COURT CERTAIN ITEMS, FUNDS, PERSONNEL AND POWERS RELATIVE TO COURTS OF FIRST INSTANCE AND OTHER COURTS OF EQUIVALENT BANK AND CITY AND MUNICIPAL COURTS

WHEREAS, under the Constitution which took effect on January 17, 1973, administrative supervision over all courts and their personnel has been vested in the Supreme Court;

WHEREAS, it is necessary to transfer to the Supreme Court certain items or positions, funds, personnel and powers related to administration of courts;

NOW, THEREFORE, I, FERDINAND E. MARCOS, President of the Philippines, by virtue of the powers in me vested by the Constitution as Commander-in-Chief of all the Armed Forces of the Philippines, and pursuant to Proclamation No. 1081, dated September 21, 1972, and General Order No. 1, dated September 22, 1972, as amended, do hereby order and decree as follows:

Section 1. Appointment and discipline of court personnel. The powers conferred by existing laws on the Secretary of Justice to appoint or approve the appointments of court personnel and to discipline and remove them from the service shall hereafter be exercised by the Supreme Court.

Sec. 2. Transfer of court appropriation. The unexpended balances of appropriations in the current General Appropriations Act (Republic Act No. 6551) for the Courts of First Instance, Circuit Criminal Courts, Juvenile and Domestic Relations Courts, and City and Municipal Courts are hereby transferred to and placed under the administration of the Supreme Court.

Sec. 3. Department of Justice personnel and appropriations related to court administration. The items of personnel listed in Annex A hereof, as well as the incumbents thereof and the unexpended balance of appropriations for their salaries, as provided for the Department of Justice in the current Appropriations Act, are hereby transferred to the Supreme Court.

The incumbents of the said positions shall remain in the Supreme Court until June 30, 1973 unless retained by the said Court beyond that date: Provided, That the employees not so retained shall be paid a gratuity at the rate equivalent to one month's salary for every year of service rendered but not exceeding twelve months on the basis of the last salary received, chargeable against savings in appropriations for the courts, any provisions of law, decree, rule or regulations to the contrary notwithstanding: Provided, further, That if said employees are entitled to gratuity or pension under any retirement law, they shall select either the gratuity or pension under the said retirement law or the gratuity provided for in this Decree.

Sec. 4. Repealing Clause. All laws and decrees inconsistent with this Decree are hereby repealed.

Sec. 5. Effectivity. This Decree shall take effect immediately.

Done in the City of Manila, this 7th day of May, in the year of Our Lord, nineteen hundred and seventy-three.
