PRESIDENTIAL DECREE No. 1754

A DECREE PRESCRIBING A CONDITION FOR AMNESTY

WHEREAS, because of subversive and destructive movements and activities against the government, and the State itself, the nation has suffered grievous wounds that must be healed;

WHEREAS, to hasten the restoration of tranquillity and stability to the nation, and achieve national reconciliation and unity, I have issued various decrees extending amnesty to those who have committed such crimes as subversion, rebellion, sedition, illegal possession of firearms, and such other offenses affecting public order and the national security penalized by the Revised Penal Code or special laws;

WHEREAS, to heal and bind the nation's wounds and prevent such from becoming permanent and festering afflictions upon the Filipino nation's unity and harmony, and thereby establish a clean, fresh and unscarred start for all Filipinos, united in one sustained effort to rebuild their nation, all thoughts of recrimination should be laid to rest;

NOW, THEREFORE, I FERDINAND E. MARCOS, by virtue of the powers in me vested by the Constitution, do hereby decree and promulgate;

1. The application for, and the acceptance of, amnesty under the provisions of any of the Decrees above mentioned shall constitute, as they hereby constitute, a waiver of any and all rights of action that the person accepting the amnesty may have had against any public officer arising out of any act, activity or conduct in connection with or in implementation of an order to arrest, detain and/or try the former.

2. This decree shall take effect immediately.

Done in the City of Manila, this 24th day of December, in the year of Our Lord, nineteen hundred and eighty.
