REPUBLIC ACT NO. 1868 - AN ACT
GRANTING BARTOLOME E. SAN DIEGO A TEMPORARY PERMIT TO CONSTRUCT,
INSTALL AND OPERATE FOR COMMERCIAL PURPOSES RADIO STATIONS FOR THE
RECEPTION AND TRANSMISSION OF RADIO COMMUNICATIONS WITH OFFSHORE
VESSELS IN PHILIPPINE WATERS |
Section 1.
Subject to the provisions of the Constitution, as well as of Act
Numbered Three thousand eight hundred forty-six, entitled "An Act
providing for the regulation of radio stations and radio communications
in the Philippine Islands, and for other purposes;" Act Numbered Three
thousand nine hundred ninety-seven, known as the Radio Broadcasting
Law; Commonwealth Act Numbered One hundred forty-six, known as the
Public Service Act, and their amendments, and other applicable laws,
not inconsistent with this Act, Bartolome E. San Diego is hereby
granted a temporary permit to construct, install, and operate for
commercial purposes and in the public interest, radio stations in the
Philippines and at such places as the said grantee may select with the
approval of the Secretary of Public Works and Communications, for the
reception and transmission of wireless messages with offshore vessels
wherever located in Philippine waters: Provided, That the grantee shall
start the operation of said stations within one and a half years from
the approval of this Act. Sec. 2. This temporary permit shall continue to be in force during the time that the Government has not established similar service at the places selected by the grantee.cralaw Sec. 3. The grantee, his successors or assigns, shall hold the national, provincial and municipal governments of the Philippines harmless from all claims, accounts, demands or actions arising out of accidents or injuries, whether to property or to persons, caused by the construction or operation of the stations for reception and transmission of wireless messages by the grantee, his successors or assigns.cralaw Sec. 4. The grantee, his successors or assigns, shall so construct and operate his radio stations as not interfere with the operation of other radio stations maintained and operated in the Philippines.cralaw Sec. 5. The grantee, his successors or assigns, is
hereby authorized to operate his radio stations on commercial
frequencies that may be assigned to him by the licensing authority,
including the international distress frequency of five hundred
kilocycles and the high distress frequency of eight thousand two
hundred eighty kilocycles. Sec. 7. A special right is reserved to the President of the Philippines in time of war, rebellion, public peril, emergency, calamity, disaster or disturbance of peace or order, to cause the closing of said stations or to authorize the temporary use and operation thereof by any department of the Government without compensating the grantee for the use of said stations during the period when they shall be so operated.cralaw Sec. 8. interpreted as an executive grant of the privileges herein provided
