REPUBLIC ACT NO. 8105
REPUBLIC ACT NO. 8105 - AN ACT AMENDING THE FRANCHISE OF KALAYAAN BROADCASTING SYSTEM, INCORPORATED, PROVIDED UNDER REPUBLIC ACT NUMBERED SEVENTY-THREE HUNDRED AND THREE, AND FOR OTHER PURPOSES.

Section 1. Section 1 of Republic Act Numbered Seventy-three hundred and three is hereby amended to read as follow:

"Section 1. Nature and Scope of Franchise. – Subject to the provisions of the Constitution and applicable laws, rules and regulations, there is hereby granted to the Kalayaan Broadcasting System, Incorporated, hereunder referred to as the grantee, its successors or assigns, a franchise to construct, install operate and maintain for commercial purposes and in the public interest radio broadcasting and television stations in the island of Mindanao with the corresponding technological auxiliaries or facilities, special broadcast and other program and distribution services and relay stations, and to install radio communication and television facilities for the grantee's private use in its broadcast activities.

Sec. 2. A new section is hereby inserted between Sections 11 and 12 of Republic Act No. 7303, and denominated as Section 12, to read as follow, thereafter the succeeding sections are renumbered:

"Sec. 12. Self-regulation by and Undertaking of Grantee. – The grantee shall not require any prior censorship in any speech, play, act or scene or other matter to be broadcast or telecast from its station: provided, that the grantee, during any broadcast or telecast, any cut off from the air speech, play act or scene or other matter being broadcast or telecast if the tendency thereof is to propose and/or incite treason, rebellion or sedition, or the language used therein is indecent or immoral and willful failure to do so shall constitute a valid cause for the cancellation of this franchise."

Sec. 3. The succeeding section are hereby renumbered accordingly.

Sec. 4. This Act shall take effect fifteen (15) days from the date of its publication in at least two (2) newspapers of general circulation in the Philippines.

(Note: Lapsed into law on July 09, 1995, without the signature of the President, in accordance with Article VI, Sec. 27 (1) of the Constitution.
